JAMMU: Justice Janak Raj Kotwal on Wednesday ordered status-quo on transfer of Assistant Commissioner Development (ACD) Jammu Suram Chand Sharma to his present place of posting as ACD Jammu till next date before the Bench. Justice Kotwal observed that impugned transfer order of the petitioner is premature and issued notices to the State and others
According to petition, Suram Chand Sharma’s transfer vide Govt order No 290- RD&PR of 2014 dated 21st October 2014 from Assistant Commissioner Development (ACD) Jammu to the post of Project Officer (WS) Reasi within a week of his posting as ACD Jammu vide Govt order No 1058—GAD of 2014 dated 16th October 2014 is premature and is in violation of transfer Policy duly notified vide Govt. Order No. 861-GAD of 2010 dated 28th July 2010. Petitioner alleged that his premature transfer is actuated by malafide for the simple reason that Commissioner/Secretary Rural Dept failed to provide the reasons which necessitated this action.
