HC stays allotment, construction of Sulabh toilets

JAMMU: In a petition filed by Saral Sugam Sewa Society challenging the allotment of construction of Sulabh Toilet by JDA to the Sulabh International Social Service Organization without any competition in a tendering process, Justice Janak Raj Kotwal observed that Petitioner claiming to be a NGO has questioned allotment process of three toilet units in Jammu City. It is contended inter alia that the State and/or its agencies/ instrumentalities cannot give largesse to any person and has alleged that allotment of construction work to respondent is actuated with ulterior and malafide consideration. After hearing both the sides, Justice J.R Kotwal found sufficient prima facie case for showing indulgence and issued notice to JDA and others and ordered that subject to objections and till next date before the Bench, impugned allotment orders dated 8th September, 2016, 20th June, 2016 and 20th May, 2016 issued by JDA in favour of private respondent shall stay and status quo as on today shall be maintained.
