JAMMU: Presiding Officer Fast Track Court Kishore Kumar rejected the bail application of one Girdhari Lal son of Punnu Ram resident of Rajiv Nagar, Jammu who was allegedly involved in rape case.
According to prosecution story on 15.11.2014 an oral report was lodged by prosecutrix at the police post Narwal to the effect that she lived in a rented accommodation at Rajiv Nagar, Narwal and one person namely Girdhari Lal also reside in that locality. On the same day at about 5:30 pm, she was passing through the street near the house of Girdhari Lal, who called her in his house and asked that there is nobody at home and requested for cooking for him and when she went inside the room, said Girdhari Lal bolted the door of the room from inside and forcibly caught hold of her and pushed her on the bed and committed rape. She raised hue and cry, however, nobody came for her rescue and on being rescued from the clutches of accused, she ran away from the spot and reached her house. At that time her mother was not home and on her arrival, prosecutrix narrated the whole story to her mother. On this a report, FIR No. 210/2014 for commission of offences under section 376, 342 RPC was registered and investigation of the case was commenced and after the completion of the investigation, offences under sections 376, 342 RPC were prima facie proved against the accused and challan was presented in the court of law.
Court after hearing both the sides observed that offences of abduction and rape are most serious offences against the woman. These offences against the woman have been viewed to be the offences against the society as a whole and letting the accused on bail in such offences if prima facie appears to be committed, would definitely have deleterious effect on the mind of the general public and would encourage re-occurrence of such crime. With these observations court rejected the bail application.
