Cop denied bail in molestation case

JAMMU: Principal Sessions Judge Kathua Vinod Chatterji Koul rejected the bail application of one Chaggar Singh Selection Grade Constable in J and K Police Department, who is allegedly involved in outraging the modesty of a woman.
According to the police case, FIR No. 92/2016 for offences punishable under Sections 354 and 382 RPC has been registered with Police Station, Lakhanpur, on the complaint of victim. The allegation against the petitioner/accused is that he along with other accused Balbir Singh entered in the house of prosecutrix, outraged her modesty and snatched her golden ear rings and Mangal Sutra. On the basis of the report, aforesaid FIR was registered, investigation was conducted and as per the report, offences punishable aforesaid sections have been established against the accused.
Justice Koul after hearing both the sides observed that when there is prima facie proof in support of the allegations of serious nature, such discretion cannot be used in favour of such defaulter. In this case, the offences alleged to have been committed by the petitioner are serious and in such offences, he cannot be allowed to be released on bail in anticipation of his arrest. Accordingly, the bail application is without any merit, which is accordingly rejected.
