Bail denied to accused in abuse of mentally retarded girls case

JAMMU: Presiding Officer Fast Track Court Kishore Kumar rejected the bail application of main accused namely Angat Kumar, son of Sat Paul, resident of Sewa Jagir, Tehsil and District Rajouri who was facing trial in rape with mentally retarded girl of Inner Wheel Rotary.
According to prosecution, one Aarti Mahajan, complainant in the case, who was a regular visitor to the Rotary Inner Wheel Home for Mentally Retarded Children at Channi Himmat, Jammu (in short ‘Home’) on 9th July 2013, approached the police station, Trikuta Nagar with a written complaint in which allegations were made with regard to the physical/verbal/sexual abuse of minor girls, who were inmates of the ‘Home’ at the hands of accused and others, besides the absence of Government guidelines for the proper functioning of the Home were also highlighted. The Incharge police station, Trikuta Nagar brought the matter to the notice of SSP, Jammu who vide his communication No. PHS/13/186 dated 10th July 2013 forwarded the complaint along with report of SDPO, City East, Jammu to the District Magistrate, Jammu. In order to investigate the allegations made by the complainant in her complaint, the District Magistrate, Jammu vide his Ref. No. DCJ/Ord/2013-14/111-118 dated 11th July 2013 constituted a five members committee, headed by Additional Deputy Commissioner, (Adm.), Jammu, Sushma Chauhan and the said committee submitted its enquiry report on 27th August 2013 wherein the findings were given by the enquiry committee in two parts viz A and B. Part-A having the observations of the committee about the general condition of Home and part-B containing the analysis based on the observations regarding the sexual ravishment of five mentally retarded girls of the Home having border line intelligence by the staff members and also by persons from outside the Home. The District Magistrate, Jammu vide his Ref. No. DCJ/PS/2013-14 /285-287 dated 29th August 2013 forwarded the enquiry report to the SSP, Jammu for necessary action under law which initially led to the registration of the case under Section 376 RPC regarding which a Special Investigating Team (SIT) headed by Rameshwar Singh SP, City South, Jammu, was constituted for investigation of the case and during the course of investigation, five alleged victim girls of the ‘Home’ (name withheld) were examined by Psychiatric board of three doctors and the opinion of the board was placed on record. After completion of investigation Challan was presented in the court of law.
Observing that the act of rape is held to be more serious than the murder as it lays a permanent scar on the life of the victim, the court rejected the bail application. JNF
