ARTO Samba, SHO, others booked for cheating

JAMMU: The Crime Branch Jammu has registered a case against ARTO, Samba, the then SHO Vijaypur and others for cheating, tempering Registration Certificate to dodge an innocent car buyer.
An FIR under Sections 420, 467, 468, 471 RPC read with Section 5(2) P.C Act Svt. 2006 has been registered on the report of State Vigilance Organisation.
According to the Crime Branch, a report of verification along with a written complaint lodged by Thoru Khan, son of Choda Khan, resident of H. No. 83 Gujjar Nagar, near Jamia Masjid, Jammu against Pawan Sharma ARTO, Samba, Ajay Singh, SHO Vijaypur, one Sohail Ahmed, son of Gulzar Ahmed, resident of Iqbal Chowk Gujjar Nagar, Jammu, Zaffar Ahmed and others was received in Crime Branch, Jammu through AIG (Hqrs) vide communication No. VO/Veri-Jmu-12/2015-1210-11 dated 25th January, 2016 for registration of a formal case.
The complainant Thoru Khan has alleged that in March, 2014 Sohail Ahmed, approached him and offered to sell him a fresh vehicle (Polo Car) for Rs. 7 lakh which he accepted and accordingly purchased the vehicle after paying Rs. 3 lakh as advance and keeping Rs. 4 lakh pending till the time of registration of the vehicle.
After some time Sohail Ahmed handed over the original Registration Certificate issued by ARTO, Samba along with other documents to the complainant and received the pending Rs. 4 lakh.
Later, the complainant came to know that the vehicle originally belonged to one Zorawar Singh, resident of Gurah Salathia, Samba who had purchased the vehicle on loan secured from J&K Grameen Bank Ltd. Gurah Salathia, Samba but there was no mention of the hypothecation on the RC provided to him by Sohail Ahmed.
On making enquiries Sohail Ahmed told the complainant that he had purchased the vehicle from one Zaffar Ahmed, resident of Channi Himmat, Jammu and that he should not worry about the bank loan as the NOC from the bank shall be obtained by him but till date neither the NOC was provided nor any response was made to the phone calls by Sohail Ahmed.
It was further alleged that Pawan Sharma ARTO, Samba in connivance with his staff and Sohail Ahmed had issued the RC without mentioning the hypothecation deliberately in order to have pecuniary benefits, because of which he purchased the vehicle but after some time Sohail Ahmed in connivance with Zafar Ahmed, Pawan Sharma, ARTO and Ajay Singh, SHO Vijaypur lifted his vehicle from Gujjar Nagar area and took the same to Police Station Vijaypur without any legal authority/FIR or report.
Ajay Singh, instead of taking any legal action against Sohail Ahmed and Zaffar Ahmed, in sheer misuse of his official powers and in furtherance of the criminal conspiracy kept the vehicle unauthorizedly in his personal possession and used the same for about a month and thereafter handed over the vehicle to Sohail and Zaffar thereby causing a huge loss to the complainant.
On receipt of this complaint, a verification was initiated in the SVO, Jammu and during the course of verification it was found that accused Sohail and Zaffar sold the vehicle owned by Zorawar Singh to the complainant for Rs. 7 lakh and thereafter in connivance with the officers/officials of the ARTO, Samba managed the transfer of RC and other documents of the said vehicle in the name of the complainant on the basis of a fake bank NOC without the consent of its original owner Zorawar Singh, who at that time was behind the bars in an NDPS case registered in Punjab.
