Tehsildar Bahu trap case: HC directs to preserve GPS locations, CDRs of ACB officials, complainant

JAMMU: High Court of Jammu & Kashmir and Ladakh at Jammu ordered for preservation of GPS locations and Call Detail Records of officers, officials of ACB Rajouri and complainant including that of petitioner namely Rohit Sharma–the then Tehsildar Bahu.
The High Court while hearing petition filed by Rohit Sharma through Senior Advocate Sunil Sethi and Adv. Parimoksh Seth has directed the Central Bureau of Investigation (CBI) present investigating agency for ensuring preservation of call detail records and GPS locations of members of trap team and the then SSP ACB Rajouri with effective from Nov 01, 2022 (date of filing of complaint) to Nov 15, 2022 and Nov 14, 2022 being date of registration and execution of impugned FIR including CDRs and GPS locations of accused petitioner (Rohit Sharma) and complainant.
Pertinent to mention that Rohit sharma had moved the high court and prayed that the impugned FIR 02/ 2022 was registered by sleuths of ACB Rajouri in violation of government order regarding jurisdiction of Police Station of ACB.
Besides, it has been averred that the entire trap proceedings were conducted in a fake, dramatised and highly motivated manner by an officer of rank of DySP and his associated team which is ample clear and evident in CCTV footages which have already been provided to the High Court by Senior Advocate Sunil Sethi in main petition No. 2788/ 2022 and is a part of court record.
During court proceedings, it was argued by Sr. Adv Sunil Sethi and Adv. Parimoksh Seth that a transparent, free and fair investigation is a matter of right of accused petitioner (Rohit Sharma) who has been implicated in a false and frivolous and highly motivated FIR by sleuths of ACB Rajouri and the present petition of seeking Call Detail records and GPS locations of concerned ACB officers, complainant in impugned FIR and petitioner has been moved to unfold the criminal conspiracy and procedural lapse conducted by sleuths of ACB Rajouri in registration and execution of impugned FIR in connivance with complainant (who already is facing more than 04 separate criminal FIRs related to forgery of Revenue records, criminal conspiracy etc).
