JAMMU: In a shocking disclosure, a senior National Conference minister is allegedly patronising a chronic land grabber in Marh village as a result of which the entry of the bonafide owner to his four Kanal plot has been restrained.
Taking cognisance of the complaint, Chief Judicial Magistrate (CJM) Jammu has directed Station House Officer, Police Station Domana to investigate into the matter under Section 156 of CrPC.
The complainant, Mohd Afzal in his complaint has stated that he along with his three brothers are owners and in possession of land measuring 4 Kanals in Khasra No. 178 situated at Village Chak Jagar, Marh, Tehsil and District Jammu, which they had purchased from one Krishan Chopra, son of Brij Lal Chopra in 1981 by virtue of a valid sale deed on 12th June 1981. The deed has been duly registered with the Sub Registrar, Munsiff, Jammu on 13th June 1981.
Thereafter, the complainant stated that being lawful owner of the land, he took over its physical possession and a mutation of ownership was also attested in favour of Afzal and his brothers Mohd. Rafiq, Arshad Hamid and Firdous Ahmad. The actual and physical cultivating possession of Afzal and his brothers was also duly reflected in Revenue Record (Khasra Girdwari) since 1981 till date.
He pointed that the earlier Khasra number 245/51 which was later on changed to Khasra No. 178 due to settlement process.
Mohd Afzal in his complaint has stated that Parshtom Lal, Pawan Kumar, Sunil Kumar, Rahul Kumar, Arvind Kumar, all sons of Prakash Chand alias Oma Prakash, Shanti Devi, wife of Prakash Chand, Vickey, Dhollo, both sons of Rattan Singh, Kaka and Vickey, both sons of Bholi and Guddi, all residents of village Chak, Jagar, Marh, are interfering and trying to forcibly encroach upon the land illegally thereby forcing Afzal and his brothers to file a civil suit against them.
Afzal in his statement stated that two FIRs. 427/2013 dated 17th November 2013 and FIR 256/2014 already stand registered against the culprits at Police Station Domana, Jammu.
“In order to protect the land from land grabbers, we dumped five trolleys of stones to construct boundary walls which was forcibly taken away by the culprits on the intervening night of 6/7th October, 2014 regarding which a written complaint has already been filed”, the complaint added.
Afzal said that despite having protection of the Court with regard to this land, he had been approaching Police Station Domana against the attempts of the ‘culprits’ but no action is being taken because of the pressure being exerted by sitting Minister namely Ajay Sadhotra.
To protect the land it has been fenced by barbed wire and 50 concrete poles, Afzal said adding a tent measuring 12’x15′ Sq. Ftt. Had also been pitched there.
On the intervening night of 26/27th October, 2014, the concrete poles, barbed wire and stones were stolen by the named persons at the instigation of the sitting NC Minister, Afzal said.
Talking to STATE TIMES, Afzal said since the police has not registering fresh FIR about theft of the fencing material, they had no option but to approach the Court to get justice.
“High Court has clarified that we are the owners of the land”, added Afzal.
