‘JEs tenure as Incharge AEs should not exceed 4 months’
JAMMU: In a significant ruling, Justice Dhiraj Singh Thakur on Tuesday ordered that the arrangement devised by placing Junior Engineers as Incharge Assistant Engineers shall not be continued beyond the period of four months and the stakeholders should take steps for filling up the said posts strictly in accordance with the rules governing the field.
In a petition filed by Ganesh Singh Baloria and three others challenging the government order dated July 18, 2014 so far as it places Avinash Sharma and Rajesh Sharma as Incharge Assistant Engineers, Mechanical on the ground that the petitioners are much senior to the private respondents according to the seniority list issued by the government on June 25, 2008.
Justice Thakur after hearing Senior Advocate, S S Lehar with Advocate Ravi Abrol appearing for the petitioners and Advocate Abhinav Sharma appearing for the private respondents issued notice to Commissioner/Secretary, PWD (R&B) and two private respondents, and ordered that till next date of hearing, the impugned order as it relates to private respondents shall remain stayed. The order further stated that it shall be open to the Government to consider the cases of the petitioners for being placed as Incharge Assistant Engineers along with others eligible. JNF
