JAMMU: Justice Bansi Lal Bhat of J and K High Court Jammu Wing on Monday ordered stay on the Govt Order No 7 GAD (Camp) of 2014 dated 17th September, 2014 and Circular No 36-GAD of 2014 dated 24th September, 2014 passed by Commissioner/Secretary GAD that rescinded transfers affected since 1st September, 2014.
In a petition filed by Simple Gupta and others who were aggrieved party, Justice Bhat after hearing senior Advocate B.S Slathia with Advocate Meenakshi Slathia appearing for the petitioners issued notice to State and others returnable within four weeks.
Justice Bansi Lal Bhat after hearing senior Advocate B.S Slathia observed that the counsel for the petitioners submitted that the impugned order was passed to deal with the emergent situation obtained in the state due to rain/flood but the petitioners who were posted at Jammu have joined their new place of posting, stayed the Govt order qua the petitioners a relieving order and further directed respondents to allow the petitioners to work at their new place of postings.
