HC quashes compulsory retirement of KAS officer

JAMMU: Justice Alok Aradhe of Jammu and Kashmir High Court on Thursday quashed the compulsory retirement order of the then Programme Officer ICDS Project, Samba Bumesh Sharma and directed the State to reinstate him with all consequential benefits within one month.
The Court was hearing a petition filed by Bumesh Sharma challenging the government order under which he was compulsorily retired in public interest. The petitioner had also sought directions to the State for allowing him to continue his service, besides according him all consequential benefits.
While setting aside the order issued on 30th June, 2015, the Court observed that compulsory retirement order cannot be passed to avoid departmental enquiry.
The Court further observed that the Committee had taken the decision to compulsory retire the petitioner, Bumesh Sharma on the basis of his involvement in First Information Reports (FIRs) and alleged irregularities in his selection, appointment, promotion and his acts of misconduct. The Committee had also come to the conclusion that he doesn’t enjoy good reputation in public, the Court added. Justice Aradhe also observed that
