JAMMU: In a petition filed by one Darshan Lal who was selected as Assistant Programmer and subsequently transferred as Assistant Programmer and was directed to report Deputy Director Accounts and Treasuries within 21 days along with certain certificates. Despite the Govt order the petitioner was not permitted to join on the ground that petitioner did not fulfill the requirement of advertisement notice. Face with such situation petitioner filed the present petition.
Justice Dhiraj Singh Thakur after hearing Senior Advocate S.S Lehar with Advocate Meharban Singh for the petitioner observed that Deputy Director could not have stopped the petitioner from joining pursuant to the order of his appointment issued by Govt especially when the order is still in force and directed respondent to allow the joining of the petitioner immediately and further directed the petitioner shall be entitled to all consequential benefits except monetary benefits.
