Despite denial to study leave, HC directs DU to enroll CUJ faculty for Ph.D

JAMMU: In a significant order Justice Dhiraj Singh Thakur of Jammu Kashmir High Court (Jammu Wing) directed Delhi University (DU) to enroll the petitioner for Full Time Ph.D Programme – 2016 at Faculty of Management Studies notwithstanding the fact that the formal letter of sponsorship as also guarantee of study leave from the parent university viz. Central University Jammu (CUJ) are not made in favour of the petitioner.
These directions were passed in a writ petition filed by Anjali Pathania, Assistant Professor, Department of Human Resource Management and Organizational Behavior, Central University of Jammu challenging order no. CUJ/Regr/2016/1501 dated August 17, 2016 whereby request of the petitioner for letter of sponsorship and guarantee of study leave for pursuing full time Ph.D Programme-2016 at Delhi University was rejected by the Central University of Jammu.
After hearing Advocate Sheikh Shakeel Ahmed with Advocate Irfan Mohd. Khan appearing for the petitioner whereas Sr. Advocate D.C. Raina with Advocate Govind Raina appearing for Central University of Jammu, Justice Dhiraj Singh Thakur observed that the petitioner is selected for undergoing full time Ph.D Programme-2016 at Delhi University. One of the conditions of enrolment of the said course is letter of sponsorship as also guarantee of study leave from the parent university and the case of the petitioner stands rejected by the Central University of Jammu by passing the order impugned bearing no. CUJ/Regr/2016/1501 dated August 17, 2016.
Advocate Sheikh Shakeel Ahmed appearing for the petitioner submitted that the petitioner is a meritorious candidate and has been selected to undergo Ph.D at Faculty of Management Studies, Delhi University but the Central University of Jammu is blocking the career progression of the petitioner on certain false / flimsy grounds. Advocate Ahmed further submitted that petitioner is fully eligible as per UGC Norms to undergo Ph.D but for no valid reasons the prayer for study leave has been rejected by the university administration.
After considering the submissions of both the sides, Justice Dhiraj Singh Thakur directed that pending final adjudication of the present writ petition, it is ordered that the Delhi University would enroll the petitioner for full time Ph.D Programme-2016 at faculty of Management Studies notwithstanding the fact that the formal letter of sponsorship as also guarantee of study leave from the parent university are not made in favour of the petitioner.
