JAMMU: Crime Branch (CB) Jammu registered a case against Mohammad Shafi Proprietor Chowdhary Trading Company, then Patwari Niabat Bari Brahmana along with Ajay Atri, son of Sardari Lal, resident of Traith Morh Talab Datta Bari Brahmana and Ram Saroop, son of Gian Chand, resident of Rani Talab Digiana, Jammu, prima facie, constitute offences punishable under Sections 420, 465, 467, 468, 471 and 120-B RPC who intentionally, deliberately and by misrepresenting the facts got identified some wrong property/land showing it to be under his ownership and possession by way of a registered sale deed before the bank officials/valuator, secured a limit of Rs. 30 lakh and thereafter, turned NPA thereby causing wrongful gains to himself and wrongful loss to the bank.
According to the Crime Branch Jammu, a written complaint lodged by Sandeep Gupta Senior Manager, Canara Bank, Bari Brahmana, Samba was received in Crime Branch wherein the complainant has alleged that Mohammad Shafi approached the bank for grant of Cash Credit Limit of Rs. 30 lakh with sub-limit of Rs. 5 lakh repayable along with interest at the rate of 13.95 per cent with security of hypothecation of stocks, book debts and collateral security in the shape of land measuring one kanal falling under Khasra. No. 166 min, Khata No. 231 min and Khewat No. 24 situated at Smailpur, Bari Brahmna opposite KFC having two shops constructed over it, which were got identified by said Mohammad Shafi to the Bank officials and the Valuator appointed by the Bank and accordingly, the CC Limit was sanctioned in February, 2015 and necessary mortgage deed was executed and registered before Sub-Registrar, Samba. A sale deed duly registered in respect of the mortgaged property was also produced by said Mohammad Shafi before the Bank and the amount was dispersed to him and lien on the mortgaged property was got marked through the revenue department. It was further alleged that the accused Mohammad Shafi thereafter, didn’t paid the installments and his account was declared NPA and process was initiated to recover the amount from his mortgaged assets but when the revenue authorities were approached for the identification of the mortgaged property the property shown/identified by the concerned Patwari was totally different having no market value than the property mortgaged with the bank, which clearly shows that the borrower Mohammad Shafi by adopting fraudulent means and misrepresenting the facts have misled the bank and had secured a limit of Rs. 30 lakh thereby cheating the bank by committing fraud and forgery etc.
