JAMMU: Additional Sessions Judge Anticorruption Udhampur Dinesh Gupta framed charges against John Mohd. Teacher (Incharge Head Master) Middle School Dharian/convener Village Education Committee and S. Pardeep Singh ZEO (Retd.) who by abusing their official position and after hatching criminal conspiracy among themselves intentionally misappropriated Rs 99,939/ for their ulterior motives resulting into wrongful loss to the State exchequer. The charge sheet produced by the prosecution and other material on record transpires that for the construction of 3 additional classrooms in the building of Govt. Mobile Middle School Upper Kund Tehsil Thuru District Reasi, estimated funds of Rs 750,000/ was sanctioned under Sarv Shiksha Abhiyan and funds were allotted to the ZEO Arnas. ZEO Arnas transferred an amount of Rs.380,000/ in two installments worth Rs 200,000/ and Rs.180,00-/ to the official account of Head Master of Govt School Dharian, for the construction of additional class room Govt School Dharian. Accused John Mohd teacher/incharge Head Master of Govt School/convener Village Education Committee (VEC) after hatching conspiracy with Contractor Khushi Mohd and ZEO S. Parmodh Singh released an amount of Rs.380,000/ to the contractor KhushI Mohd. This amount was released to raise the construction upto Lanter Level, but contractor Khushi Mohd stopped the construction upto plinth level. Excessive amount has been misappropriated by the above named person, being part of a criminal conspiracy. This constitutes offences u/sec 5(1)(d) r/w 5(2) of Prevention of Corruption Act Svt2006 and Sec 120B IPC. Additional Sessions Judge Anticorruption Udhampur Dinesh Gupta after hearing APP Himanshu Parkash for the ACB, observed that this Court is of the opinion that there is sufficient material to proceed against the accused, for the commission of offence u/sec 5(1) (C) (D) read with 5(2) of the J&K PC Act r.w.120 IPC and separate charges are made against both the accused.
