Court denies bail to husband in dowry death case

JAMMU: First Additional Sessions Judge Jammu Mohd Akram Chowdhary rejected the bail application of one Santosh Kumar, son of Ajeet Raj, resident of Galwaday Chak, Tehsil Marh who was allegedly involved in death of his wife.
According to the case Pooja Sharma, wife of the applicant on 13th October, 2014 was brought to GMC Hospital Jammu, as dead, having been poisoned and inquest proceedings were initiated to enquire into her unnatural death.
The proceedings were concluded that the deceased married the applicant on 14th April, 2012 as per Hindu customs and had a one-and -a half year old-child. According to the statement of deceased’s father, her in-laws had been taunting and assaulting for not brining car as dowry forcing her to commit suicide by taking some poisonous substance. A case was registered at Police Station Kana Chak vide FIR No. 178/2014 under sections 306/109 RPC. Chargesheet was finally concluded for the commission of offences punishable under sections 306/498-A/109 RPC and 304-B RPC.
1st Additional Sessions Judge Jammu Mohd Akram Chowdhary after hearing Senior Advocate Sunil Sethi with Advocate Summit Nayyar for the accused whereas APP Ajay Singh Manhas appearing for the state observed that deceased Pooja Sharma wife of applicant , had been subjected to cruelty by her in-laws including husband and forcing her to commit suicide, a dowry death has taken place with a period of seven years of the marriage. All other accused are stated to have been bailed out and the applicant is the only accused who is in custody and in case he is admitted to bail, he may try to tamper with the prosecution evidence and in the considered opinion of this court, the applicant/accused is not entitled to bail till material witnesses are examined by the prosecution with these observations court rejected the bail application.
