Jammu: In a significant order, the Central Administrative Tribunal (CAT) Jammu Bench comprising Member (J) Rajinder Singh Dogra has stayed the promotion of Teachers of Jammu Division for the higher post of Masters in the School Education Department. After hearing Advocate Arshad Majid Malik appearing for the petitioners/applicants in O.A. No.75 of 2024 titled Gulfraz Ahmed and seven others all Teachers belonging to Tehsil Darhal, District Rajouri and AAG Sudesh Magotra appearing for the School Education Department, the Bench headed by Rajinder Singh Dogra, Member (J) observed that at the very outset Advocate A.M. Malik has submitted that the promotion of the applicants in some cases to the post of Master is being considered on the basis of age and in some cases it is considered on the basis of merit and there is no uniform criteria adopted by the School Education Department. Advocate A.M. Malik vehemently argued that the applicants would be satisfied in case the present case is disposed of by directing the School Education Department to adopt the uniform criteria/procedure for fixing the seniority of General Line Teachers (Trained Graduates and Post Graduate Teachers) of Education Department for their promotion to the next higher post of Master, as has been done previously by the Department.
Advocate A.M. Malik further submitted that Education Department be directed not to promote the Teachers of Jammu Division to the next higher post of Master by adopting different criteria till the outcome of the instant petition.
After considering the submissions of Advocate A.M. Malik, a Bench of Central Administrative Tribunal, Jammu headed by Rajinder Singh Dogra, Member (J) directed that the original application is disposed of with a direction to the School Education Department to treat this O.A. as representation of the applicants and decided the same. The Bench further directed that the Department will convey the order so passed to the applicants and the whole exercise shall be completed within a period of one week from the date of receipt of certified copy of this Order. While parting with this order, the Bench further directed that till then no promotion should be made for the post of Teachers of Jammu Division.
