LMD imposes Rs 1 lakh fine on ‘San Disk’

JAMMU: Legal Metrology Department (LMD) imposed a fine of Rs 1 lakh on the prominent pen drive manufacturing company “San Disk” for violation of Legal Metrology Act 2009.
LMD under the supervision of Deputy Controller Enforcement Kashmir Muzafar Wani compounded a case in which a pen drive manufacturing company was booked for violation of Section (30) a, 36 (2) of Legal Metrology Act 2009.
The department took cognizance of the violation in which the claimed 64 GB pen drives were sold to the consumers when the actual capacity was only 57.2 GB. It amounted to the shortage of quantity promised by about 6.8 GB. The department served the legal notice to San Disk International and importing agency Redington India Limited and the response was received from the company through their battery of lawyers.
After the initial vacillation when they tried to justify their stand on some technical issues they finally pleaded to compound the offence departmentally rather than sending it to the court of law. They also agreed that once the existing stock will get exhaust from the market the new stock will be as per the legal metrology norms.
The pen drives manufactured by the other companies like Sony, HP etc are also under scanner and they too will be dealt under law if found in contravention of the Act.
