Bail denied in rape, abetment to suicide case

JAMMU: Presiding Officer Kishore Kumar of Fast Track Court Wednesdy rejected the bail application of Kamal Kumar S/o Mohinder Pal R/o Ward No. 3, Arnia, Bishnah, Jammu who was booked by the police in kidnapping and rape and abetment to suicide of minor.
According to police report on 17.02.2016, an information was received from reliable source that a girl (name withheld) was found dead in her house and proceedings under section 174 Cr.P.C. were initiated and during the course of investigation, statement of the mother of the victim, namely Sangeeta Devi has been recorded, who has deposed that on 16.03.2016, one boy, who is residing in her neighborhood had kidnapped her daughter and forcibly committed rape upon her and on next day, she and her husband went to their routine work and in afternoon when they came back to their house for lunch, they saw that body of her daughter was hanging with the door of the room. Perusal of the CD file reveals that the investigation of the case has not been completed so far. The accused/petitioner herein has been arrested in case FIR NO. 14/2016 on 08th of March, 2016 for the commission of offences under sections 363, 376, 306 RPC. The investigation of the case is at initial stage and the bail to the petitioner at this stage will definitely thwart the investigation. The winning over of the prosecution witnesses is also not ruled out in the circumstances of the case.
Presiding Officer Kishore Kumar of Fast Track after hearing both the sides observed that petitioner is arrested for the commission of offence u/s 363/376, 306 RPC and the investigation is at the initial stage, the petitioner stands arrested for very heinous offences and as such does not deserve bail at this stage. The argument of the counsel for the petitioner/accused has no force in view of the gravity of the offence and also the prevailing lawlessness and the increasing crime of rape in respect of rape, molestation and suicide. With these observations Court rejected the bail application.
