Woman gets acquittal in murder case

JAMMU: Principal Sessions Judge Bhadarwah Sanjeev Gupta acquitted Purna Devi who committed murder of one Omkar Singh over property dispute, as prosecution miserably failed.
According to police on 19th April, 2009 Police Station Bhadarwah received a telephonic information at 10:55 AM from Chowkidar Balwant Singh with regard to the suspicious death of Omkar Singh whose body was lying in the house of deceased itself situate at Upper Manthala.
During interrogation of accused on 21st April, 2009 it came to fore that she had committed the murder on 16th April, 2009 after both of them had a quarrel regarding some property dispute. During the argument deceased had hit accused with a ‘‘stick’’ on her leg and thereafter accused followed the deceased to his house and in retaliation gave multiple blows with a ‘‘stick’’ on his body including head due to which deceased fell unconscious in his house. It was established during the investigation that accused developed physical intimacy with the deceased whose wife had expired 12/13 years ago, with the hope that deceased may execute a ‘Will’ regarding his land in favour of her children but on the day of incident on account of refusal by the accused to provide money to the deceased which was demanded by him for consuming liquor a quarrel ensued between both which led to the ultimate death of the deceased at the hands of accused who was repeatedly hit with a ‘stick’ by the accused .
Principal Sessions Judge Bhadarwah Sanjeev Gupta after hearing Advocates Abdul Wahid and Altaf Wahid appearing for the accused observed that that prosecution has not been able to either prove the motive on the part of accused to do away with the life of the deceased or the recovery of alleged weapon of offence at the pointing out of accused after she made a disclosure statement about the same before the police. In such circumstances, in the light of evidence in record, it can be safely said that prosecution has miserably failed to prove its case against the accused beyond a reasonable doubt. Accordingly prosecution case is dismissed and accused is acquitted. JNF
