Three-yr term for negligent driving

RAJOURI: Sub Judge Special Mobile Magistrate Rajouri Naushad Ahmed Khan convicted one Prathvi Raj, son of Amar Nath, resident of Langer, Nowshera for negligent driving and sentenced him to three years imprisonment.
According to case, two persons namely Pankaj and Deepu Sharma were killed while several others received injuries after the matador (JK11-1339) which was driven rashly and negligently by the convict Prathvi Raj met with an accident near Kallar on 22nd September 2012.
The Sub Judge while convicting the accused inter alia observed that the evidence produced in the case leads to irresistible conclusion that the accused was driving the vehicle rashly and negligently which was also objected to by the passengers on board and that with due caution accident could be avoided. He also observed that evidence has to be weighed and not counted while refuting the arguments of defence counsel that prosecution failed to examine most of the prosecution witnesses. The plea of false implication by defence was not supported by any material on record nor was it taken in cross examination of witnesses by defence, the court observed. The case was professionally investigated by Rajouri police and prosecution was ably conducted by Shaid Mustafa.
