Shrine Board directed to reply in land acquisition

JAMMU: In a petition filed against Shrine board recklessly acquiring valuable lands of Katra, Justice Tashi Rabstan after hearing Advocate Vikram Sharma issue notice to respondents which was accepted by the AAG Ajay Sharma for the state and Advocate Rahul Bharti for the Shrine Board and directed them to file reply and also file objections.
During the course of hearing Advocate Vikram Sharma submitted that the petitioner owns and possesses 60 local kanal (approx.) of land in village Hut, Katra, Tehsil and District Reasi, besides possessing another 10-15 kanal of Shamlat Land in said village. The petitioner has built his house there on some part of the land and the rest of the land is also under his use and occupation.
The petitioner seeking quashment of Notification bearing no. COL/LA/ACR/REasi/14/206-209 dated 11.08.2014 issued by respondent no. 5 u/s 4 of J&K Land Acquisition Act, the same being an arbitrary exercise of power vested in respondents, and for not being in consonance with the International Civil Aviation Organization-Heliport Manual and quashing Notification no. 08-Rev. (LAK) 2016 dated 05.02.2016 (issued u/s 6 of J&K Land Acquisition Act)) and Notification seeking restraining the respondents from acquiring the land of the petitioner in the garb of the purpose purported in as much as the respondents can’t be requiring 286 kanal 13 marlas of land for taking off/ landing only one helicopter at a given time and particularly when the respondents already have 04 new Helipads in Katra form where they can operate.
