Selection list of Dental College Surgeons quashed

JAMMU: Jammu and Kashmir High Court Jammu Wing on Tuesday quashed the entire selection list of House Surgeons in Dental College Jammu.
The order came In a petition challenging the selection list of House Surgeons.
After hearing Advocate Abhinav Sharma, appearing for the petitioner Suksham Johar, Justice Dhiraj Singh Thakur observed that the entire selection and appointment must go inasmuch any re-drawing of the list in regard to four disciplines would have a cascading effect inasmuch as all the candidates would be affected by it.
Advocvate Abhinav Sharma appeared for the petitioner whereas Deputy AG PS Chandel appeared for the State and Senior Advocate D.C Raina with Advocate Anuj Dewan appeared for the 20 private respondents.
“Therefore, to save the selection and appointment in regard to some of the disciplines while quashing the selection in regard to others would lead to anomalous results and therefore, the selection and appointment of private respondents by the Principal Indira Dental College Jammu as stipendiary House Surgeons requires to be quashed in its entirety being contrary to the advertisement notification dated 20th May, 2016 and the Govt. Orders reflected therein and accordingly it is quashed”.
Justice Thakur further directed official respondents shall draw a select list afresh on the basis of merit, discipline wise. They shall, based upon merit, invite the preferences in each discipline from the candidates. This may be done through counseling. It would be open to the official respondents, if they so choose, to associate the SSRB or Public Service Commission to seek help from them for purposes of conducting the selection and counseling process and also seek their advice on those issues. However, the final decision would be taken by the official respondents themselves.
The entire process be completed preferably within a period of two weeks from today. Looking to the fact that the petitioner has been dragged into this litigation unnecessarily, cost of Rs. 25,000 is allowed in her favour, which shall be paid within two weeks.
