Roshni Act case listed on Dec 11, 2020; DB directs CBI not to target ACB cases

JAMMU: The Division Bench of the Jammu and Kashmir High Court comprising of chief Justice Gita Mittal and Justice Rajesh Bindal today in an urgent hearing motion filed by the Union Territory of Jammu and Kashmir Govt. through Aseem Sawhney, Additional Advocate General and F.A Natnoo, AAG heard the application for preponement of the date in the much publicised Roshni Act cases and early listing.
The division bench of the High Court of Jammu and Kashmir after hearing Mr Aseem Sawhney additional advocate general allowed the application of the Govt. Sawhney AAG cited urgent reasons for the review petition to be heard expeditiously.
Sawhney submitted before the court that the matter requires urgent consideration as the poor landless owners who were benefited under the Roshni Act too have been targeted along with the wealthy and unscrupulous elements which was never the intention; besides the CBI could conduct a roving enquiry into the pending ACB cases as well as the cases where the challans have been presented by the Anti Corruption Bureau of J&K and these reasons warranted urgent intervention of the court.
The court also heard Mr SS Ahmed advocate for the petitioner and Monica Kohli for the CBI allowed the application moved by the additional advocate general for the Govt and fixed the matter for 11th December 2020 for hearing the review petition moved by the government of Jammu and Kashmir.
The court also observed that the CBI should not selectively target first the cases where anticorruption bureau is already dealing with the matter or challans have been presented and further directed the CBI to present the status report in a sealed cover to the bench.
The court cautioned the CBI from conducting a roving enquiry against small officials and land owners and directed that the CBI enquiry must first focus on the ‘big sharks’ as per the verbal observations made by the court in the virtual hearing.
Today’s order is a significant victory for the government of Jammu Kashmir in projecting its urgent hearing application and now the matter is fixed for 11 to December 20 20 for further hearing.
