JAMMU: In a Public Interest Litigation regarding misappropriation of food grains meant for public in which it has been highlighted the colossal misappropriation by disappearance of food grains meant for public distribution to the resident of the areas like Dachhan (Kishtwar). In respect of one year period from April 2012 to March 2013 a shortfall of food grains worth more than Rs.48 lakh has been reported. The matter came to the notice of this Court when the officers sought to be transferred on the allegation of shortfall of food grains approached this Court against their transfer and posting. In the order it has been made clear that the aforesaid shortage for the year 2012-2013 is only a tip of iceberg.
A Division Bench of State High Court comprising First Puisine Judge Justice Ramalingam Sudhakar and Justice B.S Walia disposed off the PIL with the direction that the Officer to pursue the recovery proceedings and take all necessary steps for proper implementation of the Public Distribution System and submit a final report in this regard preferably within one month to the Registry.
When the PIL came-up for hearing, G.S Chib Director CAPD Jammu, who was present in the Court submitted that various remedial measures have been taken by the Department to ensure that Public Distribution System is tuned and all efforts are being taken to make recovery of the amounts which have been swindled by some of the CAPD employees.
Division Bench after considering the oral submission of the Director CAPD Jammu, convinced that his Officers are taking adequate measures to address the issues raised in this Public Interest Litigation and discharge the Director CAPD from further appearance.
Division Bench further observed that in view of the submission of the Director CAPD Jammu, the instant Public Interest Litigation is closed along with connected MPs. The Court directed the Officer to pursue the recovery proceedings and take all necessary steps for proper implementation of the Public Distribution System and submit a final report in this regard preferably within one month to the Registry.
