DB issues notice to CS, Secy GAD, others
JAMMU: In Public Interest Litigation (PIL) seeking quashment of backdoor appointments in Engineering Departments, a Division Bench of State High Court comprising Justice Ali Mohammad Magrey and Justice Bansi Lal Bhat issued notice returnable within two weeks to Chief Secretary J and K, Commissioner/Secretary GAD, Executive Engineers PHE, Irrigation, Flood Control, PWD, M and RE, PHE Mechanical of District Kathua and Deputy Commissioner Kathua.
The PIL has been filed by Shiv Shanker Sharma to hold the J and K Civil Services (Special Provisions) Act, 2010 dated 28th April, 2010 as ultra-vire to the Constitution of India violating the spirit of Article 14 and 15 of the Constitution of India as made applicable to the State of J and K and consequentially quash/cancel the appointments given illegally through backdoor, depriving various lawful and eligible aspirants from public employment, arbitrarily in serious and transgression of the constitutional and legal sanctity of the law of land.
