The direction came on a complaint jointly filed by two families through Gurdas Kumar, father of one candidate and Suman Lata, the mother of another candidate, who were duped by these employees.
After hearing Advocate Altaf Hussain, the Magistrate directed Crime Branch Jammu to investigate the matter under Section 156 (3) CrPC.
The perusal of complaint revealed the identity of accused as Kamaljit Singh, Meter Reader at Green Belt Division-II Gandhi Nagar, Jammu and Gurpreet Singh, an employee of General Administrative Department (GAD), Civil Secretariat, Srinagar.
According to the complaint, the complainants had approached the accused for government jobs for their children and were made to pay Rs. 11.20 lakh in October, 2014 in lieu of appointment orders, purported to have been issued by Under Secretary, GAD, Civil Secretariat, Jammu on 22nd November, 2014.
When the candidates, Rajeswar and Shivam Sharma approached the concerned department for joining, they were not allowed, saying that no such orders had been issued by the GAD.
The complainants filed an application in terms of Right to Information Act which came to be replied vide reply dated 12th April, 2016 by the Under Secretary to Govt. GAD (PIO) stating that no Government Order bearing No. 971-GAD of 2014 dated 22nd November, 2014 had been issued.
The Court, after going through the contents of the complaint, duly supported with an affidavit and after perusing the documents appended with it, observed that the complainants had been duped by the accused government employees of their hard earned money clandestinely and the matter needed to be investigated thoroughly so that the money extracted from them could be recovered and paid back. The Court also sought the accused to be dealt in accordance with law.
