JAMMU: Special Judge Anticorruption Jammu AK Koul Monday awarded one year imprisonment and fine of Rs 5000 to the then patwari Halqa Seoura Jammu who was facing trial in trap case.
The facts of the case are that a complaint was lodged by one Deepak Chopra (herein after referred to as complainant) before Sr. Superintendent of Vigilance Organization Jammu on 16.02.2010, alleging therein that he had purchased land measuring 03 kanals 12 marlas at village Seora Jammu under Khasra No.207. He approached accused Patwari for attestation of mutation of land so purchased by him along with a photocopy of the sale deed and treasury receipt. A sum of Rs.5000/- was also paid to him on his demand as bribe but he demanded a sum of Rs.13000/- more for attestation of the mutation and under compelling circumstances he is going to pay him the demanded sum.
On the basis of this complaint case FIR No: 04/2010 was registered in police station Vigilance Organization and trap was laid and after completion of investigation challan was presented.
Special Judge Anticorruption Jammu Mr. AK Koul after hearing CPO Harminder Singh for the VOJ whereas Sr. Adv PN Raina for the accused, observed that only fair conclusion that can be drawn from the facts and legal position discussed above is that the charges against the accused have been proved to the hilt. The accused has failed to make out a plausible defence or even create a dent in the prosecution version, which could suffice to create a suspicion about the genuineness of the prosecution case and as such the court is left with no option but to hold him guilty for commission of offences under sections 5(1) (d) r/w 5(2) of P.C. Act and Section 161 of RPC accordingly convicted on both the charges and awarded one year imprisonment and fine Rs 5000.
