Missing domestic help; DB seeks status report, appearance of IO

JAMMU: Division Bench of State High Court comprising Justice Hasnain Masoodi and Justice Janak Raj Kotwal on Wednesday sought detailed status report and presence of Investigating Officer with case diary in case pertaining to missing domestic help from a Judge’s house in Bathindi.
Observing that Senior AAG had not come up with the status report nor had the presence of the Investigating Officer (IO) been ensured, the DB passed on directions for compliance on 25th May 2015
Advocate Deepika Singh Rajwat has filed an application for constitution of a Special Investigation Team (SIT) to investigate into the mysterious disappearance of a domestic help from a Judge’s resident. Besides petitioner’s personal appearance, Senior AAG S.S Nanda appeared for the state while Senior Advocate Sunil Sethi represented the private respondent.
Advocate Deepika Singh Rajawat told STATE TIMES that she was humiliated by Senior Advocate Sunil Sethi by alleging that she was pleading this case just for the sake of publicity.”
“I am running an NGO ‘Voice for Right’ for the helpless children and am determined to expose more such cases involving bureaucrats, politicians and other influential persons who were encouraging child labour,” she added
In the application, the petitioner sought the constitution of a Special Investigation Team (SIT) to investigate the mysterious disappearence of a 15 year-old boy, namely Rafiq Choudhary, who is missing since 12th April 2015 from the residence of Chief Judicial Magistrate, Rajouri. He had allegedly employed him as domestic help in violation of Child Labour Act, 1986 three years ago. It was also sought in the petition that appropriate legal action be initiated/ recommended against the erring Judicial Officer for employing minor as domestic help.
In the application, petitioner submitted that on 10th May 2015 morning she got a phone call from a reliable source about the mysterious missing of a child namely Rafiq Ahmed resident of Village Ragura, Nagrota, Tehsil and District Jammu who was employed as domestic help by Chief Judicial Magistrate, Rajouri, Mehmood Choudhary, resident of Bathindi, Jammu in violation of Child Labour Act, 1986 three years before when he was only 12 years of age. The petitioner after locating the parents of the child rushed to their Village Ragura at the outskirts of Jammu near ASCOMS Sidhra, Jammu and the poor parents informed her that since 12th April 2015 their child is missing from the residence of the aforementioned Judicial Officer and the Police have miserably failed to locate the missing child.
They further divulged that the said Judge and his wife have refused to share the details of their missing son and threatened to deal with them. JNF
