They are ‘misguided’ in Kashmir; ‘lunatic’ in Jammu

JAMMU: The Valley centric government in Jammu and Kashmir has a set format and terminology for describing situations and defining persons, involved in various acts of omissions and commissions in the two district regions.
If a terrorist strikes against Indian nation in the Valley, he is called a misguided youth and if a security personnel discharges his duties against law-breakers, he is accused of violating human rights of innocent people (even if they are ultras, known in local parlance as Mujahids).
Similarly, if a radicalized youth desecrates worship place of a particular community in the Jammu region, he is promptly shielded and defended as a ‘lunatic’ and if in similar situation, any outsider is caught roaming in interiors of the Kashmir Valley, he is dubbed as a Jana Sanghi on a mission from Nagpur to commit sacrilegious acts.
The hypocrisy of the administration got exposed in the case of a Doda youth, who desecrated most revered temple of Aap Shambu in the outskirts of the winter capital, with reportedly avowed objective of flaring up of communal passions, ahead of Shri Amarnathji Yatra in Kashmir Himalayas. In a strategic bid to shield the offender, a senior Home Department official made out a strong case to lose the noose around the desecrator.
The State Home Department in Jammu and Kashmir may not have approved the Public Safety Act (PSA) slapped on the accused involved in desecration of famous temple in Upper Roop Nagar area of Jammu claiming the grounds of detention were not justified but in contrast to this the police dossier clearly exposes the sinister design aimed at creating communal wedge between the members of different communities in Jammu.
In a communication to the District Magistrate, Jammu, Special Secretary State Home Department had claimed on 23 June 2016 that the accused Yasir Alfaz was widely reported to be a ‘lunatic patient’ and the grounds of detention were not justified. In contrast to this the police dossier clearly indicated that he is an unemployed youth who after passing his 12th class examination enrolled himself for ITI course (plumber). He is 25 years of age and is married.
Nowhere, the comprehensive dossier submitted by the SSP,Jammu to District Magistrate Jammu makes any reference of him being a ‘lunatic patient’ or undergoing any psychiatric treatment or seeking consultation from any consultant in Jammu.
The police dossier, prepared by office of SSP Jammu, also throws enough light on the sinister design behind desecration of the temple premises in Upper Roop Nagar area of Jammu.
As per the dossier, the copy of which is in the possession of STATE TIMES, Yasir Alfaz barged inside the Aap Shambu temple on June 14 around 18:15 hours with the criminal intention of thrashing idols inside the famous temple.
The dossier says, “The motive of Yasir Alfaz was to create communal wedge between the two communities and create communal disharmony.”
“The right to live and safeguard the properties, guaranteed by the Constitution of India and J&K has been disturbed in the area due to undesirable activity of the subject”, the dossier stated. In the dossier police also claimed the accused having committed mischievous act and created communal disharmony, whose remaining at large will be pre-judicial to public order.
“The unchecked manoeuvring of the subject is highly hazardous for the peace loving of the state and is highly prejudicial to maintenance of public order and deterrence for the security of the peace loving citizens of the state especially in view of forthcoming Amarnath yatra”.
The police dossier also makes categorical mention of the fact that the subject is in police custody and it is necessary to detain him under the provisions of the J&k Public Safety Act, keeping in view the present law and order scenario in the state and to stop the subject from indulging in any such incident, which has the potential to flare up the situation and possibility of turning in to communal tension in the state of J&K, which may endanger life and property of the general public.
In the interest of society, since the substantive law is not sufficient to deter him and curb his criminal activities and unchecked manoeuvring of the subject, which is highly hazardous for the peace loving people of the state and in order to prevent the subject from indulging in such criminal activities, it is necessary to detain him under the provisions of the Public Safety Act,1978. The SSP, Jammu also recommended his detention under the PSA for maximum period to check his criminal activities.
