Man lands in Court on Reception Day, seeks justice from ‘wife’ City Judge asks Police to register case

JAMMU: Say it irony or fate, a man reached Court to seek justice from his ‘wife’ on the Reception Day. And the Court directed the Police to register an FIR against the accused persons. The man alleged that the woman in question was already married and was awaiting divorce.
The complainant tried to exposed notoriety of the woman who along with her parents and a tout hatched a criminal conspiracy to contract the marriage, as alleged by the complainant, while concealing the fact that she was already married with a man four years back and her divorce case was pending before the Court.
Judicial Magistrate First Class/City Judge (Duty Magistrate), Jammu M. S Manhas directed the Police to register an FIR against the accused persons in the aforementioned case.
The complainant Rajiv (33), son of Som Nath Raina, resident of Paloura, Jammu in his application alleged that Payal Sharma, daughter of Chiranjee Lal Sharma, resident of Paloura, Jammu in connivance with her parents and a middle-woman viz. Anju Sharma hatched a conspiracy to contract marriage with him while concealing the fact that she was already married to one, Ranjeet Singh, son of Dilip Singh, resident of Thather, Paloura in 2013.
The complainant further informed that he married Payal Sharma on February 5, 2017 and his reception was scheduled to take place on 8th February, 2017.
When the groom came to know about the conspiracy, he lodged a complaint in Police Station, Paloura where he was advised to file the case in Judicial Court.
Accordingly, the complainant filed a case in the Court of Judicial Magistrate First Class/City Judge through his counsel, Ravinder Parihar and sought directions to SHO, Janipur to register an FIR against the respondents under Sections 406, 415, 417, 420 and 120-B RPC.
The complainant also produced a copy of the petition filed by the girl against her previous husband, Ranjit Singh for divorce which is sub-judice in the Court of Additional District Judge (Matrimonial cases) Jammu for which, the next date of hearing is 22nd February, 2017.
The Court, after perusal of the case and taking into account the documents placed on the record, observed that the allegations made against the accused persons are very serious in nature and require proper investigation. With this observation, the Court directed Incharge Police Station, Janipur to register an FIR against the accused persons in terms of Section 156(3) CrPC.
