JAMMU: Principal Sessions Judge Kathua Vinod Chatterji Koul rejected the bail application of Lecturer Shah Nawaz, who was booked by Bani Police in sedition case.
According to the police case, a written report was lodged with Police Station on 30th November 2016 vide No. 13 for offence punishable under Section 153-A RPC and copy of the report was sent to District Magistrate, Kathua for filing formal complaint and accused Shah Nawaz, son of Mohammad Latif Dar, resident of Dogripora, Tehsil Awantipura, District Pulwama was arrested and after obtaining the complaint from District Magistrate, Kathua FIR No. 48/2016 for offence punishable under section 153-A RPC was registered. As per the report, Manoj Kumar along with Tilak Raj, Ganesh Kumar and Subash students of B.A Part-III made a written report with Police Station, Bani, in which they alleged that they are undergoing study in B.A Part-III in Government Degree College, Bani that a professor Shah Nawaz started teaching them history and started topic about the encounter, which took place at Samba and Nagrota on 29th November 2016. He said that Pakistani persons came here as lions, kill the Indians and returned. He also claimed that there are 150 militants in Kashmir for whom he can give his life. They are having fire arms AK-47 and he also said that he will provide all types of assistance to the militants. The Muslim students are following the professor vitiating peace in the College and the Muslim students attend the college by wearing Afgani clothes. After registration of the FIR, the petitioner/accused was arrested and police started investigation. As per the investigation conducted so far, police has found the offence punishable under Section 153-A RPC established against the accused.
Principal Sessions Judge Kathua Vinod Chattterji Koul after hearing both the sides observed that in view of the provision contained in Section 497-B Cr.P.C and the fact that there are grounds for believing that he has committed offence and that two weeks have not been expired, as such, application is rejected.
