Land allotment to Jammu Club;Status quo to be maintained: Court

JAMMU: A Division Bench of J and K High Court comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur on Thursday disposed off the Letter Patents Appeal (LPA) filed by Pipleshwer Shiv Mandir Management Committee (PSMMS) against the judgment of Writ Court and directed that status quo shall be maintained till a fresh decision is taken by the Writ Court.
The Court was hearing LPA filed by PSMMS against Writ Court order in which the Writ Court had dismissed the petition seeking directions to quash order of Vice Chairman, Jammu Development Authority dated 4th December, 2004 under which land measuring 4 kanals 3 marlas and 178 Sq. feet was alloted in favour of Jammu Club and to quash the communication dated 20th September, 2004 issued by Commissioner/Secretary to Govt., Housing and Urban Development Department proposing to allot the aforesaid land to Jammu Club.
While setting aside the order of Writ Court, the Bench observed that from the amended writ petition that appellant has raised all the issues in this appeal and during the hearing of the writ petition, the Single Judge by interim orders directed to explain the certain facts as referred to above.
