JAMMU: Presiding Officer Fast Track Court Y.P Kotwal rejected the bail application of one Yash Pal who was allegedly involved in rape and kidnapping case.
According to the police, on 6th September, 2013 one Ajay with whom prosecutrix was having love affair had sent a SIM card for the prosecutrix through Yash Pal, the accused. At the time of handing over the SIM card to the prosecutrix, the accused told her that Ajay has also come, so she should meet him, and he will arrange their marriage. Upon assurance of the accused, the prosecutrix accompanied him to his house where accused raped her. On this police registered a case and after completion of investigation a Challan was presented.
Presiding Officer Fast Track Court Y.P Kotwal after hearing both the sides observed that sexual violence apart from being a de-humanising act is an unlawful intrusion on the right of privacy and sanctity of woman and a rapist not only causes physical injuries but more indelibly leaves a scar on the most cherished possession of a woman i.e. her dignity, honour, reputation and not the least her chastity, Court further observed that rape is not only a crime against the person of women and female but is a crime against the society. With these observations Court rejected the bail application. JNF
