How long will status of Internally Displaced Persons & not of ‘refugees’ will continue for POJK-1947 DPs?

Shri Anil Yeshwant Desai MP Lok Sabha vide UNSTARRED QUESTION NO- 2071 had among other details asked “(a) whether some part of our Kashmir which is called Pakistan occupied Kashmir (PoK) is still in the illegal occupation of Pakistan, if so, the efforts being made to push back Pakistan from PoK; and………….” In reply it has been on 1st August 2025 that The Minister of State in the Ministry of External Affairs Shri Kirti Vardhan Singh had in a written reply had said ” Pakistan has been in illegal occupation of parts of Indian Union Territories of Jammu & Kashmir and Ladakh. Government of India has consistently called upon Pakistan to immediately vacate all areas under its illegal and forcible occupation. Government of India has lodged strong protests with the Government of Pakistan and rejects all attempts by it to bring material change in these occupied territories. It has been India’s consistent and principled position that the entire Union Territories of Jammu & Kashmir and Ladakh have been, are and will always remain integral parts of India. This was enunciated in the unanimously adopted 1994 Resolution of the Indian Parliament. The official maps published by the Government of India unambiguously represent entire Union Territories of Jammu & Kashmir and Ladakh, including the territories illegally occupied by Pakistan, as parts of the Union of India.>
Leaders are often found making public speeches about POJK/POK liberation / 22nd February 1994 Parliament resolution introducing the resolution more as Parliament’s resolve that J&K is integral part of India where as what Parliament had resolved was that Pakistan must vacate the occupied areas. As regards J&K being integral part that was just reiterated keeping in view Art-1 of Constitution of India. Question is has Pakistan been asked by India to withdraw from POJK peacefully by some appointed date in terms of the Feb 22 1994 Parliament resolution ? It is already over 77 years now ,how long will the status of Internally Displaced Persons & not of ‘refugees’ will continue for POJK-1947 DPs?
In 2025 it had been now attack on the tourists by 3- 4 militants ( as per reports all were Pakistani nationals ) in Baisaran valley ( Pahalgam) killing 26 male Indian subjects after identifying them as Hindu on 22-04-2025 and India launched operation Sindhoor on 7 May deep into POJK/ Pakistan destroying the militant hides and ‘7’ training camps there.Pakistan tried to attack some areas along LOC/IB in India and it was afte that the Indian air force damaged around ‘9’ Pakistan airforce basis on 8/9 May 2025 that Pakistan DGMO ‘requested ‘ Indian DGMO for a crasefire on 10th May afternoon and India ( a votary of peace ) accepted the ‘request’ with the condition the operation Sindoor has been simply halted and any attack/ indirect on India will again activate Operation Sindoor.
India has suspended the Indus Water Treaty (19-09-1960) on 24-04-2025 and Pakistan on 25 April 2025 was quoted as having suspended the 1972 Shimla Agreement (Former Indian Prime Minister Shrimati Indira Gandhi and former Pakistan President Shri Z.A. Bhutto signed the historic Simla Agreement on bilateral relations on July 3, 1972 at Shimla , India ) . Pakistan’s Defence Minister, Khawaja Asif, has called the 1972 Simla Agreement a “dead document” that is no longer relevant ( he was speaking in a televised interview) stating that Pakistan has effectively returned to the 1948 position on Kashmir, and the Line of Control (LoC) is now a ceasefire line, not a formal boundary. Anyhow there remains no scope for settling the Indo Pak issues through bilateral talks only. So the question is how to address the demand of Parliament of India asking that Pakistan must vacate the occupied areas of India State of J&K.
So, going by all that and claims of government functionaries of the day is it still not appropriate time for Government of India to : (i) Issue a final call on Pakistan to immediately withdraw her forces/ people from the areas of Indian state of J&K that have been illegally occupied after 1947/48 otherwise no option will be left with India than to get vacation by any other possible means including militarily (ii) Draw the attention of UN Security Council to para- 1 of January 1st 1948 complaint which India had had made as a responsible member country and also inform UN Security Council that it has been now more than 7 decades since India requested UNSC to prevail upon Pakistan to vacate the illegally occupied areas of Indian state of J&K but still no result has come and hence India is asking Pakistan to withdraw her forces from occupied areas by an appointed date since India can not afford to wait for more time and people of POJK areas have suffered enough for over 7 decades and POJK areas are also being used by some more anti India forces under the patronage of Pakistan to disturb peace / stability in other parts of Indian state of J&K through militant / terrorist/ separatist activities (iii) Keep the options open for use of force in case Pakistan does not respond favorably in the given immediate time.
Unless that is done return of peace and stability in “the J&K” may not be there for some more decades.
