JAMMU: Justice Bansi Lal of J and K High Court Jammu Wing has stayed the premature transfer of Ch. Mohammad Nawaz Tehsildar who was also appointed as Assistant Electoral Registration Officer Nowshera.
Justice Bansi Lal after hearing Advocate A.M Malik appearing for the petitioner, issued notice to the respondents and ordered that respondents to consider the case of the petitioner being retained at Nowhsera in view of the circular 44 of GAD of 2014 relating to the norms laid down by the Election Commission of India with regards to appointment of Returning Officer/ Assistant Returning Officers and pass appropriate orders and till the petitioner shall be retained at present place of posting.
Petitioner has sought quashing of Govt. order No.Rev/Gaz/ 261 of 2014 dated 29th October, 2014 qua the petitioner whereby the petitioner in violation of the instructions issued by the Election Commission of India and also in violation of transfer policy in vogue was transferred from Tehsil Nowshera to Tehsil Kharaballi.
