JAMMU: In a petition filed by Dr. Reeta Kotwal presently working as Medical Officer Govt Hospital Gandhi Nagar who was transferred to SDH Bhaderwah vide order dated October 24, 2014 and relieving October 25, 2014. The petitioner challenged the order on the ground that impugned order have been passed on the eve of Modal Code Conduct issued by the Election Commission. It is further submitted that the petitioner has been singled out by over-looking the fact that she has served for more than 12 years in erstwhile Doda District and impugned order is also assailed on the ground of being an arbitrarily exercise of power based on malafides.
Justice Bansi Lal Bhat of J and K High Court Jammu Wing after hearing Advocate SS Ahmed with Advocate Irfan Khan, issued notice to the respondents returnable within four weeks’ and in the meanwhile Court directed that subject to objection from other side, operation of impugned transfer order and reliving order shall stayed and petitioner shall be allowed to continue at Govt Hospital Jammu irrespective of such reliving order.
