HC stays common seniority lists of Section Officers

JAMMU: Justice Bansi Lal Bhat of J and K High Court Jammu Wing issued notices to respondents, returnable within four weeks and in the meanwhile, subject to objections from other side stayed common seniority lists of Section Officers of HODs issued by the General Administration Department.
The direction came in response to a petition filed by Abdul Rashid Baba for quashing the common seniority lists of Section Officers of HODs issued by the General Administration Department vide Notification no. GAD (Estt) M-16/2009-I dated 28th August 2012, the seniority list vide Government Order No. 263 -GAD of 2014 dated 4th March, 2014 and the common seniority list vide Government Order No. 471-GAD of 2015 dated 28th March 2015 issued by GAD vide No. GAD (Estt) 16-2009- dated 30th March 2012.
Justice Bansi Lal Bhat after hearing Advocate Vikram Sharma appearing for the petitioner, stayed the operation of Government Order No. 471-GAD of 2015 and communication No GAD (ESTT) M-16/2009-1 dated 21st August, 2014.
During the course of arguments, Advocate Vikram Sharma appearing for the petitioner submitted that in 1987, the Directorate of Indian Systems of Medicine, J and K was created and established as an independent and full-fledged Department at state level under the administrative control of state level Director. No recruitment rules for subordinate service of newly created department of ISM have been sanctioned so far. However, the requisite qualification laid down in the Non-Gazetted rules of sister concern viz. Health and Family Welfare subordinate service under SRO-20 is considered for promotion and pursuant to the inception of separate and independent Directorate of Indian System of Medicine, J and K by segregating the wings of ISM from the Directorate of Health Services Jammu/Kashmir in the year 1987.
