JAMMU: Taking strong exception of police inaction in the rape of two Bakerwal women JIMC Majalta issued notice and directed Investigation Officer to file latest status report of the case
The petitioners settled at Village Charawa (near Mansar Lake) falling in Tehsil and District Samba approached Police Station, Majalta with a written complaint alleging the accused Mohd. Anwar had raped them and an FIR No.55/2014 dated 6th October, 2014 under Section 376/342 RPC was registered against the respondents.
On 7th October, 2014 the statement of the petitioner No.2 was recorded before JMIC, Majalta under Section 164-A CrPC and similarly the statement of prosecutrix was recorded on 9th October, 2014 before the said Court.
More than 40 days have expired from the date of registration of FIR No.55/2014 but there is no headway in the investigation as the accused are roaming freely in the society and are extending open threats to the petitioners and their family members. The police are investigating the matter casually and has so far not taken serious steps to arrest the accused in such a heinous offence. The police cannot be allowed to act as a mute spectator as he is under a legal/statutory obligation to investigate the matter fairly uninfluenced by the political patronage enjoyed by respondents.
Justice Mohammad Yaqoob Mir of J and K High Court Jammu Wing after hearing Advocate S.S Ahmed appearing for the petitioner/prosecutrix issued notice and directed IO of the case to file latest status report of the case. JNF
