HC quashes PSA of 2 detenues

SRINAGAR: High Court of Jammu & Kashmir and Ladakh quashed detention orders of two detenues held under Public Safety Act (PSA) last year and directed concerned authorities to release them from custody.
The Court, while hearing two separate petitions filed by one Irshad Ahmad Reshi, resident of Taj Mohalla Tral-i-Payeen, District Pulwama and Mehraj-ud-Din Dar, resident of Manz Mohalla, Anchar, Soura challenging their detention orders passed by the District Magistrates Pulwama and Srinagar respectively, quashed the orders and directed authorities to release both the detenues forthwith from the custody, if they are not required in any other case.
Justice Sanjay Dhar, quashed detention orders of duo on grounds that the detenues cannot be expected to make an effective and purposeful representation, which is their constitutional and statutory right guaranteed under Article 22(5) of Constitution of India, unless and until the material, on which detention is based, is supplied to detenue. The failure on part of detaining authority, to supply the material, renders detention order illegal and unsustainable; the Court observed and quashed the orders.
