JAMMU: Justice Janak Raj Kotwal of J and K High Court on Tuesday stayed the pre-mature transfer of Director Industries Dr. Abdul Rashid and issued four weeks’ notices to Chief Secretary, Secretary GAD, Sajjad Ahmed Kichloo Minister of State for Industries and Commerce (independent charge), Showkat Ahmed Zargar presently posted as Director Industries and Faizullah PRO to Minister of State for Industries and Commerce (independent charge).
The petitioner challenged the Government Order No. 1091-GAD of 2014 dated 21st October, 2014, whereby the petitioner has been transferred pre-maturely with malafide exercise of power at the behest of respondent from the Post of Director, Industries and Commerce Jammu and posted as Project Director, Sarva Shiksha Abhiyan, which is in contravention to the transfer policy framed by the State Government based on Cabinet Decision No. 156/12/2010 dated 27th July, 2010 and notified vide Govt. No.861-GAD of 2010 dated 28th July, 2010.
Justice Kotwal observed that transfer of the petitioner, prima-facie is premature in face of his earlier transfer order dated 16th July, 2014 issued by the Cabinet and issued notice and directed respondents to file objections and ordered that till next date the impugned transfer order of the petitioner shall stayed.
