HC orders status-quo on GAD’s circular for rescinding transfers
JAMMU: In a petition filed by Santosh Kumar and others, General Line Teachers aggrieved by the Government order No. 7-GAD (Camp) of 2014 dated September 17, 2014 issued by General Administration Department whereby GAD banned all transfers, attachments, etc and ordered that all the transfers and attachments made by School Education Department since September 1, 2014 rescinded the transfers of petitioners who were transferred by different orders and different dates in the month of September, 2014. Petitioners have also sought for quashing the GAD circular.
Justice Tashi Rabstan of J&K High Court, Jammu Wing after hearing Advocate Arshad Majid Malik appearing for the petitioners issued notice to Commissioner/Secretary GAD, Commissioner/Secretary School Education, Director School Education and others returnable within four weeks and directed the respondents to file objections.
Court further ordered that subject to objections from other side and till next date of hearing, status-quo with respect to the position of the petitioners on date shall be maintained. JNF
