HC keeps in abeyance transfer of Lecturer

Jammu: In a petition filed by one Sarabjeet Singh who was working as a Lecturer of Physical Education at SRML High School, Jammu was transferred to Boys Higher Secondary School Bishnah. According to the petition that the Directorate of Youth Services and Sports and Technical Education Department, transfers and postings were being made without following the due procedure and business rules and without seeking any approval of the minister concerned. When this issue came to the notice of the government more particularly the Minister for Youth Services and Sports Department, the minister through Special Assistant issued instructions vide order dated 13th May, 2015 to all the Administrative Secretaries/HoDs that no transfer and posting of any officer/official at any level shall be made without the prior concurrence of the Minister.

During the course of arguments Advocate  Ravi Abrol appearing for the petitioner, who leveled allegations against Director General, Youth Services and Sports that by abusing his official position in order to accommodate Surinder Singh for malafide reasons and ulterior considerations, issued the impugned order dated 18th May, 2015 by virtue of which  Surinder Singh has been sought to be adjusted in Government SRML Higher Secondary School, Jammu vice the petitioner and the petitioner is sought to be transferred to Hr. Secondary School, Bishnah against a vacant post of Physical Education Lecturer. The post of Physical Education Lecturer against which he was previously transferred just a month back, has been kept vacant.

Justice B.S Walia of Jammu and Kashmir  High Court Jammu Wing after hearing Advocate Ravi Abrol appearing for the petitioner issued notice to respondents and ordered that the transfer order of petitioner shall be kept in abeyance. JNF
