HC grants interim bail in rape case

JAMMU: State High Court granted interim bail to Maqsood Hussain who was facing trial in rape and kidnapping case.
Petitioner is facing trial before the Court of Sessions Judge, Poonch, as he has been charged for the commission of offence punishable under Sections 376 (1) (2), 363 and 109 RPC in FIR No.138/2010 registered at Police Station Poonch. The petitioner is seeking bail on the ground that the evidence of prosecution has already been closed vide order dated 1st November, 2014 and the case was fixed for recording the statement of accused under Section 342 Cr.P.C. It is also stated that the petitioner is in detention for the last many years. During the pendency of bail application, petitioner filed a miscellaneous petition for placing on record the medical record of his treatment along with order dated 16th November, 2015 passed by the Trial Court for shifting him to Government Medical College, Jammu for his treatment in view of kidney disease with which he was suffering. It is stated that though the petitioner has been shifted from District Jail, Poonch to District Jail, Amphalla, Jammu for further treatment in Government Medical College, Jammu, the DTPA Scan facility is not available at Government Hospitals at Jammu. Thus, under these circumstances, the petitioner is seeking bail on medical grounds for getting his treatment at PGI, Chandigarh.
State High Court after considering both the sides observed that taking into consideration the kidney disease of petitioner and the fact that the advised facility is not available at Government Hospitals at Jammu, deemed it proper to admit the petitioner to interim bail for a period of twenty days with effect from 1st to 15th July, 2016 so that he could get the required facility/treatment at PGI, Chandigarh with the condition that he will surrender on 15th July, 2016 in the Jail where he is presently lodged, provided he furnishes bail bond to the tune of Rs 50,000 to the satisfaction of Registrar Judicial of this Court and personal bond of the like amount to the satisfaction of Superintendent District Jail, Jammu, with the condition that he will not jump over the bail or tamper with the prosecution witnesses.
