HC directs to unseal Pink House

JAMMU: Justice Tashi Rabstan of State High Court Jammu directed Station House Officer, Police Station Janipur to de-seal premises namely Pink House Upper Roop Nagar and handover the same to the petitioner provided she is not required to be in custody in any other offence.
The direction came in response to a petition filed by Shaheeda Parveen who was allegedly involved in running the brothel at Pink House challenging the order of District Magistrate (DM) Jammu whereby he has sealed her house namely Pink House situated at Upper Roop Nagar Jammu after the registration of case under Sections 376, 109, 342 and 506 RPC and 4/5 Immoral Trafficking Prevention Act 1956 at Police Station Janipur Jammu.
Justice Tashi Rabstan after hearing both the sides observed that Sub Inspector, Police Station Janipur has stated that Challans were filed against the petitioner and one Sushma Devi before the competent Court of Law.
High Court further observed that a bare perusal of the order impugned reveals that custody of the said premises viz. House No. 405, Sector No. 2 Upper Roop Nagar, Jammu is extended further for a period of one year or till the completion of investigation into the case whichever is earlier and in view of the statement made by Tara Chand, Sub Inspector Police Station Janipur Jammu and stand taken by AAG, as the Challans have been produced before the competent court of law against the petitioner and one Sushma Devi, the instant petition is disposed off with a direction to Station House Officer, Police Station Janipur Jammu to de-seal the said premises/house.
