HC directs State to go ahead with installation of STP at Leh

JAMMU: In a petition seeking quashment of Consent Order No. 1638 of 2016 dated 14.03.2016 issued by J&K Pollution Control Board, through its Member Secretary vide Serial No.SPCB /T/C/ 40/ 5540-43 dated 14.03.2016 in favour of Executive Engineer, Public Health Engineering Division, Leh for establishment of Sewage Treatment Plant at Agling, Leh on the ground that process of construction of a Sewage Treatment Plant at Agling, Village Spituk in violation of Air (Prevention and Control of Pollution) Act, 1981; Water (Prevention and Control of Pollution) Act, 1974 and Environment (Protection) Act, 1986.
Justice Tashi Rabstan of J&K High Court Jammu Wing after hearing both the sides dispose of the writ petition with a direction to respondent No.3 to go ahead with the installation of Sewage Treatment Plant at Agling, Leh.
However, the same shall be strictly in terms of the conditions as contained in the impugned consent order and the mandatory standards as are prescribed for establishment of such STPs. Respondent No.3 is further directed to construct and design the STP in such a way that it would not emit any foul smell nor would pollute the water stream which is adjacent to the proposed STP, rather it must be good for keeping the environment clear and also good for public at large. While establishing the STP, respondent No.3 would also strictly follow and implement the observations made by the National Green Tribunal, Principal Bench, New Delhi in Application No.124/2013, titled as, Kehar Singh vs State of Haryana, decided on 12.09.2013. It is made clear that the Sewerage Department shall not operate the STP until the J&K Pollution Control Board issues its consent to operate fresh. Further, keeping in view the topography of Leh and that the period of working season is very less, generally April to September and is expected to construct and complete the STP in the above terms with utmost expedition.
