HC directs JKPC for closure of brick kilns operating without environment clearance

JAMMU: Justice Tashi Rabstan of J and K High Court directed Chairman Jammu and Kashmir Pollution Control Board for closure of all brick kilns operating without Environmental Clearance Certificate from the authority.
This significant direction has been passed in a petition filed by one Suresh Kumar Sharma seeking implementation of Supreme Court order in Deepak Kumar Vs State and others dated February 27, 2012 for closure of those brick kilns which are operating in the State of Jammu and Kashmir without obtaining requisite environmental clearance certificate from State Environment Impact Assessment Authority and seeking direction to the respondents for order closure of all brick-kilns operating in the State of J and K. Justice Tashi Rasbtan after hearing Adv Abhinav Sharma appearing for the petitioner issued notices to Commissioner/Secretary Forest Dept, Commissioner/Secretary Revenue Dept, J and K State Pollution Control Board through its Chairman, Divisional Commissioner and Divisional Commissioner Kashmir returnable within four weeks and in the meanwhile subject to objections from other side and till next date, directed Chairman Pollution Control Board to issue relevant orders in terms of judgment of Apex Court for closure of all those brick kilns which are operating without obtaining requisite environmental clearance certificate from State Environment Impact Assessment Authority and directed him to file status report before next date of hearing.
