Harnek Singh Murder Case: 3 brothers get life-imprisonment

JAMMU: The 2nd Additional Sessions Judge Jammu Amit Sharma on Monday awarded life-imprisonment to three brothers in a murder case.
According to case, on January 8, 2014 complainant namely Avtar Singh in an injured condition along with his brother Ujwaljeet Singh lodged a written report effect that he alongwith his friend namely Harnek Singh, resident of W.No. 12 Tehsil R.S.Pura were going back to their houses in an Alto Car of his friend (JK02AD-0981) at about 8:30 PM from Jammu. As soon as they parked the car in a street on the main road near their houses. The accused Harvinder Singh alias Pinka, Amarjeet Singh alias Babu and Harcharan Singh alias Charna sons of Lakhmir Singh resident of Railway Patri Tali Morh R.S.Pura were already present there in a truck (JK02T-9825) with common criminal intention, lashed with deadly weapons and made a murderous attack with a kirch first on him after damaging the wind screen of the Alto car with the help of base ball bat and thereafter the accused Harcharan Singh dragged the complainant Avtar Singh from the car and the accused Harvinder Singh attacked with a kirch on the right side of his abdomen.
Thereafter, the accused Amarjeet Singh and Harcharan Singh dragged Harnek Singh from the vehicle and accused Harvinder Singh attacked upon him with the kirch and put many blows on his abdomen due to which the deceased died on spot.
After hearing APP Arvind Rathore for the UT and Sr. Advocate Sunil Sethi for the accused persons, the 2nd Additional Sessions Judge Jammu
observed that the murder in this case has taken place due to enmity vis-a-vis to the street between the PW-1 and father of the three accused and there is nothing on record to term this murder a case falls within the definition of “rarest of rare” cases to warrant capital punishment. In this backdrop, convict Harvinder Singh is therefore, convicted for the commission of offences under sections 302/307/34 RPC and 4/25 Arms Act and sentenced to life imprisonment and fine of Rs. 10,000 for commission of offences punishable under sections 302 RPC.
The convict is also sentenced to imprisonment for a period of five years and fine of Rs. 5,000 for the commission of offence under section 307 RPC. The convict shall also undergo imprisonment of one year and fine of Rs 1,000 for the commission of offence under section 4/25 Arms Act. And in case of fault of fine he will further undergo imprisonment of one month each in the respective offences.
Convict Harcharan Singh is also convicted for the commission of offences under sections 302/307/34 RPC and sentenced to life imprisonment and fine of Rs. 10,000 for the commission of offence under section 302 RPC. The convict shall also sentenced to imprisonment for a period of five years under section 307 RPC and fine of Rs. 5,000. And in case of default of fine further undergo imprisonment of one month each in the respective offences.
Convict Amarjeet Singh, convicted for the commission of offences under sections 302/307/34 RPC and sentenced to life imprisonment and fine of Rs. 10,000 for the commission of offence under section 302 RPC. The convict is also sentenced to imprisonment for a period of five years and fine of Rs. 5,000 for the commission of offence under section 307 RPC. He is also sentenced to imprisonment for a period of one year and fine of Rs 1,000 for offence under section 427 RPC. And in case of default of fine he will further undergo imprisonment for a period of one month/one month each in the respective offences, court ordered.
