Former PA to CE I&FC Kashmir awarded 2-yr imprisonment in trap case

SRINAGAR: The Special Judge Anti Corruption Srinagar convicted one Mohammad Amin Baba, son of Late Abdul Ahad Baba, resident of Buchpora, Srinagar in FIR No. 02/2005 of Police Station VOK (now ACB). The accused was sentenced to undergo simple imprisonment for period of two years under Section 5 (2) of PC Act and one year simple imprisonment under section 161 of RPC. The Court also pronounced fine /penalty of Rs 10,000 to accused in each offence.
As per details of case, accused Mohammad Amin Baba, then in the capacity of PA of Chief Engineer Irrigation & Flood Control had demanded and accepted bribe amounting to Rs 2,000 from complainant for his transfer. Accordingly, a trap team was constituted and accused was caught red handed while accepting bribe and money was also recovered from his possession in front of independence witnesses. The Vigilance Organisation, (now ACB) after nabbing accused red-handed, carried out detailed investigation and thereafter presented charge-sheet before Court for judicial determination, after obtaining sanction from the Government.
Judge C L Bavoria, after hearing both sides, sentenced the accused to undergo simple imprisonment for period of two years under Section 5 (2) of PC Act and one year simple imprisonment under section 161 of RPC. The ACB was represented by Special Public Prosecutor, Ghulam Jeelani and Wajahat Jameel, Public Prosecutor while case was investigated by then Superintendent of Police, Ghulam Qadir Mir.
