JAMMU: In a LPA, seeking stay of floor test for the post of Chairman LAHDC, a Division Bench of State High Court comprising Chief Justice N Paul Vasanathakumar and Justice Dhiraj Singh Thakur on Wednesday observed that Advocate General has produced notification dated 12th August, 2016 directing that the words “each elected member” appearing in Clause (c) of Rule 94 A of the Ladakh Autonomous Hill Development Council (Election) Rules, 1995, the words “each member” shall be substituted and the nominated members can vote.
Upon this, Division Bench directed that the floor test is scheduled to be held on 27th August, 2016 and declaration of the result shall be subject to result in the writ petition as well as the appeal.
Advocate Mohsin Qadri appeared for the appellant and Advocate General Jehangir Iqbal Ganai for the State.
